As you navigate the application process for both City of Oakland (City) and State cannabis permits/licenses, we understand this can be challenging. The City’s goal remains to assist you in successfully navigating these requirements and obtaining an Annual Cannabis Permit from the City.  

To streamline this process, ensure compliance with the City’s approval requirements for cannabis businesses, and align with the state’s permitting system, we are implementing the following changes immediately to those operators who have not yet obtained a City Annual Cannabis Permit:

  • Local Authorization for a Provisional State License will not be renewed, as the state is no longer issuing Provisional Licenses. Moving forward, all eligible businesses must request a "Conditional Operating Permit".  This permit is now the required Local Authorization for obtaining an Annual State License.
  • Conditional Operating Permit Requirement: All businesses with an active State Provisional or Annual License are required to obtain a "Conditional Operating Permit” from the City and pay the permit fees listed below (fees waived for Equity Applicants). This is a requirement to operate and is effective immediately and the process for requesting is covered below.
  • Monthly Updates(PDF, 631KB) : You are still required to submit your monthly progress updates by the 5th of each month as outlined in your 120-day Compliance Plan Agreement. You will no longer be required to submit your 120-day Compliance Plan Extension payments, as administrative costs for these payments will be incorporated in the Conditional Operating Permit fee.

Cannabis Conditional Operating Permit Requirements

  • Filed Notice of Exemption(s)(PDF, 153KB)
  • Proof of good standing with the 120-day Compliance Plan Program(PDF, 308KB)
  • Copy of your current Business Tax Certificate
  • Certificate of Occupancy #
  • Proof of Recent Fire Inspection (within last year)
  • Proof of enrollment in the Renewable 100 program (Cultivators Only)
  • PG&E Load Study: (For cultivation applications submitted on or after October 1, 2024, and exceeding 20,000 sq ft individually or collectively on the same parcel).
  • Annual Large Cultivation Fee Paid (For cultivation operations exceeding 5,000 sq ft.)
  • Copy of Checklist Card(s)
  • Proof of Insurance(PDF, 208KB) (For Delivery-Only Dispensaries and Transporters only)
  • Pay Annual Permit Fee: An annual permit fee will be required, based on your projected gross sales. 
    • Gross Sales > $1,000,000: $13,218.00 1st activity; $6,089.00 for each additional activity for same operator at same location.
    • Gross Sales = $500,001 - $999,999: $6,604.00 1st activity; $2,452 for each additional activity for same operator at same location.
    • Gross Sales < $500,000 - $3,587 1st activity; $1,328 for each additional activity for same operator at same location.
