The Housing Element is part of Oakland's General Plan. It guides housing plans for residents at all income levels, including low-income households and people with special housing needs.

The California Department of Housing and Community Development (HCD) confirmed that Oakland's 2023-2031 Adopted Housing Element meets all requirements under State Housing Element Law (Article 10.6 of the Gov. Code) on February 17, 2023. You can view HCD's full compliance letter(PDF, 182KB).

What is the Housing Element?

The Housing Element is a required part of Oakland's General Plan. By identifying goals, policies, and programs, it provides a plan for meeting the city's housing needs by protecting existing homes and residents and supporting new housing development.

The Housing Element was last updated in 2015. The current update uses community feedback to address new housing needs, challenges, and opportunities in Oakland. It also helps the City meet new state housing requirements.

City Releases 2023-2031 Housing Element Public Hearing Draft

On Tuesday, November 29, 2022, the City of Oakland released the 2023-2031 Housing Element Public Hearing Draft.

The City updated the draft based on community feedback and state housing requirements.

The Public Hearing Draft includes:

• An executive summary
• An updated Housing Action Plan (Chapter 4)
• Proposed Rezoning Changes (Appendix J)
• Oakland's response to the State Housing and Community Development (HCD) findings letter (Appendix K)
• Responses to public comments (Appendix L)
• Additional updates and supporting information

The City also shared the draft with the California Department of Housing and Community Development (HCD) on November 29, 2022. Under Assembly Bill 215 (AB 215), the draft was formally submitted to HCD on December 7, 2022, after the seven-day public review period (November 30 to December 6, 2022).

After the review period, draft remained open for public comments until December 29, 2022.

The City received 54 comment letters and emails(PDF, 15MB) between November 29 and December 29, 2022. These comments were included as supporting documents for Planning Commission and City Council public hearings beginning in January 2023.

Draft Housing Element: Timeline of Development

• May 12, 2022 - June 13, 2022 - First Draft of Housing Element Available for Public Comment
  The first Draft Housing Element was available for public review for 30 days, as required by AB 215. The City reviewed public comments before sending the updated draft to State HCD. 
• June 30, 2022 - Draft Housing Element Sent to HCD for Review
  City staff updated the draft based on public comments and submitted it to HCD for a 90-day review. Additional comments were addressed in the second public draft released on November 29, 2022.
• June 30, 2022 - September 28, 2022 - Extended First Draft of Housing Element Available for Public Comment
  The City kept the first public draft available for comments during HCD's review period. This gave the Oakland community more time to review the document and share feedback. Thank you to everyone who submitted comments and participated in public meetings.
• November 29, 2022 - December 29, 2022 - Release of Public Hearing Draft of Housing Element for Public Comment
  The City released the second public review draft of the Housing Element on November 29, 2022.
• January 2023 - Adoption of Housing Element Public Hearing Draft
