Apply for Change of Compliance Tier

A Petition for Change of Compliance Tier allows an owner to show that the building that is subject to the Mandatory Soft Story Retrofit Program is eligible for the later deadlines of a different Compliance Tier per the Oakland Municipal Code (OMC) Chapter 15.27

When Can I Petition to Change My Building's Compliance Tier?

If your building is subject to the Mandatory Soft Story Retrofit Program but appears to have been assigned to the wrong Compliance Tier, you may submit a form to petition for a Change of Compliance Tier. In most cases, a determination by a design professional and other appropriate documentation is required in order to approve a petition. Need more time? You can apply for a 1-year extension to meet your deadline. Please complete the Request for Extension of Compliance Deadlines form(PDF, 209KB).

How to Apply

Step 1.Step One: Complete the Form

Download the Petition for Change of Compliance Tier form. Fill in all sections of the form and sign. Please follow the Petition for Change of Compliance Tier - Instructions(PDF, 249KB) for guidance on how to correctly complete the form.

Make sure all sections are filled in correctly before submitting. Any incomplete or incorrectly filled forms must be revised and resubmitted.

Step 3.Step Three: Application Review

Once we receive your application, we will review your petition within five days of submission. If we need further information, we will contact you. Upon review of your application, we will send you an email statement confirming whether your building qualifies for a change of Compliance Tier per OMC 15.27.
