Cannabis Operator Regulations & 120 Day Compliance Plan

The final version of the City of Oakland's Cannabis Operator Regulations is now available here.

These regulations include an option for cannabis operators who have not yet completed the City's permitting process to be locally authorized for a provisional state license by entering into a 120 Day Compliance Plan, which is available here.

With regards to this Compliance Plan option please note:

  • $264.50 Fee per 120 days is required once you have submitted your Compliance Plan.
  • Operators that have already obtained a permit do not need to enter into a Compliance Plan.
  • The Compliance Plan is an OPTION, not a requirement.
    • If an operator prefers to take their time completing the City's permitting process, there is no need to enter into a Compliance Plan. In this scenario, the operator will not be locally authorized to operate until they have obtained a permit.
    • On the other hand, cannabis operators who have not yet obtained a permit AND are interested in being locally authorized to operate BEFORE they have completed the City's permitting process need to enter into a Compliance Plan.

If 120 days have passed since you entered into a compliance plan and you have not completed the cannabis permitting process, you may extend your deadline another 120 days of local authorization by paying the $264.50. You should then send an email to cannabisapp@oaklandca.gov outlining what progress you have made towards the milestones identified in the compliance plan and what steps you need to complete in order to finish the permitting process.
