Your Responsibilities as a Property Owner

The sidewalks on your property are your responsibility as a property owner to maintain.

Many people don't know that according to state law, property owners are responsible for the maintenance and repair of sidewalks on their property. If someone is injured by a damaged sidewalk in front of your property, you can be held liable and sued for damages. Maintenance and repair of sidewalks is the property owner's responsibility, except when damage is caused by an official City street tree.

You may repair your sidewalk in two different ways:

• Repair the sidewalk yourself. A City permit is still required if the repair area is less than 25 square feet, but the application fee is waived.

• Hire a licensed contractor with a Class B, C-8 or Class A license and a current, valid Oakland Business License to repair the sidewalk. A City permit is required if the repair area is greater than 25 square feet.
