File this certificate with the Rent Adjustment Program within 30 days of an Owner of Record commencing occupancy of a unit within a property that is divided into two or three units as a principal residence. This certificate must be filed annually to evidence continued owner-occupancy.

HOW TO COMPLY WITH CERTIFICATION OF OWNER OCCUPANCY FOR PROPERTIES WITH TWO OR THREE UNITS
(Rent Board Regulation 8.22.360A.8-9 / 8.22.350.F)


If an Owner of Record begins occupancy pursuant to an Owner Occupancy of Properties with Two or Three Units (O.M.C. 8.22.350.F), then the owner must file a Certificate of Owner Occupancy (Form COO-01) within 30 days of occupancy with the Rent Program on the provided forms. An Owner of Record is a natural person with at least a 33 percent interest in the property.

The regulations are designed to provide reporting requirements to better assure compliance with the Owner-Occupancy Exemption from the Just Cause for Eviction Ordinance and the Rent Adjustment Ordinance.

Owner Occupancy of Property with Two or Three Units (Reg 8.22.350.F)

A. Following an Owner Move-In Eviction (O.M.C 8.22.360A.8-9)

1. Within 30 days after tenant leaves the unit following (1) a notice terminating tenancy for owner move-in or (2) other communication stating the owner’s intent to seek recovery of the unit for owner or relative move-in, prepare and file with the Rent Program an Initial Certificate (Form NFE-01).
2. An Owner of Record commencing occupancy of a unit in a property with two or three units as a principal residence, must file a certificate with the Rent Program attesting to the occupancy in addition to any evidence of occupancy as required by the Certificate of Owner Occupancy for Properties with Two or Three Units (Form COO-01).
3. This certification must be provided every twelve (12) months from the initial move-in date until the property is no longer exempt.
4. If the property is no longer exempt from the Just Cause ordinance (e.g. if you moved out), you must notify the Rent Program.

B. Following an Owner Move-In to a Vacant Unit

1. An Owner of Record commencing occupancy of a unit in a property with two or three units as a principal residence, must file a certificate with the Rent Program attesting to the occupancy in addition to any evidence of occupancy as required by the Certificate of Owner Occupancy for Properties with Two or Three Units (Form COO-01).
2. This certification must be provided every twelve (12) months from the initial move-in date until the property is no longer exempt.
3. If the property is no longer exempt from the Just Cause ordinance (e.g. if you moved out), you must notify the Rent Progra
